Terms of Service

1. Acceptance of Terms

By using ChildhoodReads (“the Service”), operated by ChildhoodReads, 418 Broadway STE N, Albany, NY 12207, USA, you agree to these Terms of Service. If you do not agree, please do not use the Service. We may update these terms from time to time, and continued use constitutes acceptance of the updated terms.

2. Service Description

ChildhoodReads is an AI-powered service that creates personalized children's picture books. You provide character information — photos or descriptions of people, pets, or objects — choose a theme, reading level, and art style, and our AI generates a unique illustrated storybook. Books are available as:

• Digital ebooks — PDF downloads, plus an online page-flip reader
• Printed books — Saddle stitch, hardcover casewrap, or collector's edition (linen hardcover with dust jacket), manufactured and shipped by Lulu

3. User Accounts

You may use ChildhoodReads as a guest or create an account. If you create an account, you are responsible for:

• Providing accurate information
• Keeping your password secure
• All activity that occurs under your account

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and make purchases. Guest users can create books but should save their book link, as books cannot be recovered without it.

4. Subscriptions

We offer two subscription plans:

• Storyteller — 3 ebooks per month, unused credits roll over (up to 12 max), 10% off printed books
• Library — Unlimited ebooks, 20% off printed books, priority generation

Subscription terms:

• Subscriptions are billed monthly or annually through Stripe, depending on the plan selected.
• Subscriptions auto-renew at the end of each billing period unless cancelled.
• You may cancel at any time from your account settings or Stripe billing portal. Cancellation takes effect at the end of the current billing period — you retain access until then.
• Unused book credits (Storyteller plan) expire when your subscription ends and are not refundable.
• We reserve the right to change subscription prices with 30 days' notice. Existing subscribers are grandfathered at their current rate until their next renewal after the notice period.

5. Pricing, Payments & Tax

• Ebook: $4.99 per book (or included with an active subscription).
• Printed books: Prices vary by size and binding, starting at $14.99 plus shipping. Exact pricing is shown before checkout.
• Sales tax: Applicable sales tax is calculated and collected at checkout based on your location, as required by law. Tax is shown as a separate line item.
• All prices are in US dollars (USD). Payments are processed securely by Stripe.

6. Print Orders

• Printed books are manufactured and shipped by Lulu, a third-party print-on-demand provider.
• Shipping costs are calculated based on your address and selected shipping speed, and are shown before checkout.
• Estimated delivery dates are provided by Lulu and are not guaranteed.
• Cancellation: Print orders may be cancelled for a full refund while in “pending” status (before production begins). Once an order enters production, it cannot be cancelled.
• If your printed book arrives damaged or defective, contact us within 14 days for a replacement or refund.

7. Refunds

• Ebooks: Because each book is custom-generated, we cannot offer refunds based on subjective dissatisfaction. However, if a technical issue prevents your book from being generated, we will resolve the issue or provide a full refund. You can review and edit the story before illustrations are created.
• Printed books: Full refund if cancelled before production. Replacement or refund for damaged/defective books within 14 days of delivery.
• Subscriptions: No partial refunds for the current billing period upon cancellation. If you believe you were charged in error, contact us.

8. Content Ownership

Your content: You retain ownership of all photos you upload and any text you write or edit. The generated story text and illustrations for your books are yours to use for personal, non-commercial purposes (including printing, gifting, and sharing with family).

Our license: By using the Service, you grant us a limited license to process your photos and content solely for the purpose of generating your books. We do not claim ownership of your content and do not use it for any other purpose.

9. Gifting

You may share your completed books with others via gift links. Gift recipients can view the book online without creating an account. By sharing a gift link, you acknowledge that anyone with the link can access the book. Gift links do not expire.

10. Acceptable Use

You agree not to:

• Upload photos of anyone without their consent (or their guardian's consent for minors)
• Use the Service to create inappropriate, harmful, or illegal content
• Attempt to reverse-engineer, copy, or redistribute the Service
• Use automated tools to access the Service in bulk
• Resell books created with the Service without our written permission

We reserve the right to suspend or terminate accounts that violate these terms.

11. AI-Generated Content

Books are created using AI technology (including large language models and image generation models). While we strive for high quality, AI-generated content may occasionally contain imperfections in text or illustrations. We provide review and editing tools so you can ensure the story meets your expectations before illustrations are generated. We are not responsible for unintended content produced by AI systems.

12. Limitation of Liability

ChildhoodReads is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total aggregate liability for any claims related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Albany County, New York.

14. Dispute Resolution

Before filing any formal claim, you agree to contact us at hello@childhoodreads.com and attempt to resolve the dispute informally for at least 30 days.

If informal resolution fails, any dispute shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will be conducted in Albany, New York, or remotely if mutually agreed. You may opt out of arbitration by sending written notice within 30 days of first using the Service. Nothing in this section prevents either party from seeking injunctive relief in court, and claims eligible for small claims court may be filed there instead.

15. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or a prominent notice on the website at least 14 days before taking effect. Your continued use of the Service after changes constitutes acceptance.
